摘　　要：近年来,中国海洋环境污染事故频发,其中相当一部分行为具有严重的社会危害性、已经构成犯罪,但中国刑法既有的重大环境污染事故罪对于打击严重危害海洋环境的行为显得力不从心,因此,海洋环境污染的刑事司法调控既是严密刑事法网之需,也是国际趋势和中国履行国际条约义务的必然历史要求。In recent years,frequent accidents of pollution of the marine environment in China,of which a considerable part of behavior has the serious social harmfulness,already constitute a crime,but China's criminal law have failed to be the lack of appropriate regulation specific offenses. The crime of major environment pollution accident to combat serious harm marine environmental behavior appear,so,harm marine environmental crime shall go to the front desk,included in the legislation. This is not only the need for strict criminal law,is also the international trend and our country to fulfill the requirement of international treaty obligations. In the criminal law regulation of harm marine environment,law enforcement can not be ignored.
