Institutional Resolution of Conflicts Between Academic Power and Administrative Power——Based on the Comparisons of Twenty-three University Statutes in China

摘  要:截至2014年7月,教育部相继核准了中国人民大学等23所大学的章程。这些大学章程的颁布,是否从制度设计层面上推动了学术权力与行政权力的冲突化解?体现在哪些方面?通过比较分析这23所大学的章程文本,发现:行政权力越位的潜在空间极大,弱防范性规制制度存在的院校极少、作用范围单一或模糊,弱协调性规制制度存在的院校极多,作用范围极广。尽管通过大学章程来缓解学术权力与行政权力的冲突极其困难,但是,弱防范性和弱协调性规制制度的存在,表明学术权力与行政权力的冲突正在通过大学章程制度的建立逐步走向缓解。The Ministry of Education has authorized twenty-three University Statutes by July 2014. Have these enacted university statutes resolved the conflicts between academic power and administrative power from the institutional level? And how did they embody?The results of this paper are based on the comparisons of these university statutes. And we discover that the offside of administration power has large potential space. Furthermore, the weak preventive constraints exist in very few institutions and the influential scope is very narrow, while weak coordinative constraints exist in many institutions and the influential scope is very wide.The results suggest that it be difficult to resolve the conflicts between academic power and administrative power through the establishment of the University Statutes. However, the existence of weak preventive constraints and weak coordinative constraints suggest that the conflicts relieve through the establishment of the University Statutes.
