摘　　要：依法执政是新时期中国共产党执政的基本方式,其实质就是依宪执政。坚持依法执政,首要是坚持依宪执政,这是由宪法的根本法地位、党与法治的关系以及宪法的实施现状所决定的。中国共产党作为执政党的依法执政,必须完全按照宪法和法律的规定,领导立法,带头守法,保证执法,推动国家制度法治化、规范化。Exercising state power according to law is the basic way of the Communist Party of China in the new period,whose nature is to exercise its power according to constitution. It is decided by the basic status of constitution,the relationship between the Party and the rule of law,the status quo of constitution's carrying out. The Communist Party of China must lead legalization,keep law and ensure the practice of law according to the rules of law and constitution.
