探析我国建筑法规中的施工许可制度

摘　　要：建筑许可制度是《中华人民共和国建筑法》中明确规定的一项基本制度。建筑许可包括建筑工程施工许可和从业资格两个方面。本文主要介绍施工许可制度,从它的概念入手,着重分析申请领取施工许可证应该具备的条件,不领取施工许可证擅自开工需要承担的法律后果,为建设单位有效落实施工许可证制度奠定基础。The building permit system is a basic system of 'construction law of the people's Republic of China'. Two aspects including the construction permit construction license and qualification. This paper mainly introduces the construction permit system, starting from its concept, focuses on applying for a construction permit conditions should be provided, not for construction permits unauthorized started to bear the legal consequences of the construction unit, and lay the foundation for the effective implementation of the construction permit system.
