摘　　要：知识产权担保融资是现代企业重要的融资渠道。产权界定与资产评估是知识产权担保融资的基本前提和环节。知识产权出质既要遵从权利质权设定的一般规范,又应当遵循知识产权法关于权利转让的特别规定。知识产权质权的效力,集中体现于出质人义务的履行及某些权利受到一定的限制,以及质权人权利的行使及其在某些方面得到的扩张。我国《担保法》应当赋予出质人对出质知识产权享有充分的实施权。It is an important way for modern enterprises to solve the fund shortage by guaranteeing fund-circulation of intellectual property (IP). And property right affirmation and capital assessment are the basic premises and procedures of guaranteeing fund-circulation by IP. It is requested, when setting mortgage of IP, not only the basic criterion of mortgage should be abided by, but also the special regulations of right transference with regarding to IP. The force and realization of IP mortgage are mainly reflected by the right and obligation between mortgagers and mortgages.
