摘　　要：对于行政不作为的界定,不仅是出于理论上研究方便的需要,更重要的是它直接涉及到行政机关及其工作人员所承担法律责任的问题,而理论界对行政不作为行为的界定也是众说纷纭。对行政不作为进行界定,必须从行政不作为的构成着手,行政不作为作为一种特殊的行为方式有其特殊的构成;对行政不作为与行政作为进行区别有助于进一步认识行政不作为的特点。To define administrative act of omission . it is necessary for theoretic research , and it ismore important for the administrative body and its personnel to bear legal responsibility . In theoretic field , there are many different versions about administrative act of omission .we should know the formation ofit , it has its own specific formation as a special action . Distinguishing between act of omission and act ofadministration will help us further understand its characteristics.
