摘　　要：战俘享有人道主义待遇,驻伊美军的虐囚行为己违反了《关于战俘待遇的日内瓦公约》等国际人道主义法的相关规定,属于酷刑行为,构成国际犯罪,应当承担相应的国家责任。The prisoner of war should enjoy humanitarian treatment.The American army in Iraq ill-treating the prisoner of war has violated the Geneva convention relevant to the treatment of prisoners of war and other international humanitarian law provisions. The ill-treatment belongs to torture and be part of international crime, should undertake state responsibility.
