摘 要:随着我国经济的发展 ,房地产业也呈现快速发展的态势 ,许多市民纷纷购买商品房 ,由此而产生的商品房买卖纠纷也急剧上升。我们认为 ,在处理银行按揭付款购买商品房的合同纠纷时 ,应妥善处理房地产开发商、商业银行与消费者三者之间的利益。由于在贷款利息与本金的计算、强行按揭保险、购买人寿保险、商品房预售合同登记、优先受偿权等方面 ,法律规定存在相互矛盾或者空白等问题 ,直接损害了广大房地产消费者的利益 ,有关方面应引起高度重视 。Along with the economic development in China, the real estate industry also develops rapidly, which results in the citizens' purchase of the merchandise housing and the soar of disputing cases in the purchase of merchandise housing. An effective way should be found to reconcile the interest conflicts among the bank, the real estate developer and customers in handling such cases. As there still exists controversial regulations and even blind law areas in the calculation of loans and their interest, the enforced mortgage insurance, the purchase of life insurance, the registration of the preparatory contract about merchandise housing, and the priority of indemnification, which directly harms customers' interest, the government in charge of the business should focus high attention on it so as to find some countermeasures to protect customers' interest.
