摘　　要：生物技术的飞速发展把人类推到一个全新的时代——基因时代,与基因有关的知识产权保护问题空前凸显出来。为此,有必要确立新的知识产权保护体系,即从知识产权的主体、客体、性质、立法思路方面推进这场知识产权的法理革命,以此确立适应新时代的知识产权理念。Rapid development of biological development brought the human being into a new era-the era of gene, and protection of intellectual property right is appearing. Thus it is necessary to set up a new system of intellectual property right protection, which means pushing forward the revolution of theory of law in intellectual property right protection from such aspect: the subject, object and nature of intellectual property right to cater to the concept of intellectual property right in the new age.
