论合同显失公平制度的完善

摘　　要：公平是一切私法行为的应有之义 ,显失公平制度是私法的应有之规。然而在我国规范财产流转关系的主要法律规范中 ,作为维护公平原则的重要制度———显失公平制度却未尽完善。本文探讨完善该制度的具体措施 :明确基本内涵、确定构成要件、析化法律效果 。Fair is the basic meaning which could be found in the private actions.Unfairness system is the must regulation include in the private law.However,among all those Chinese Legal norm which used to maintain the regular circulation procedure of property relationship,unfairness system is not perfect.The article its practical meanings in order to give clear definition of its basic meanings and constitute elements,also to promote the legal effect,so as to exert the best efficacy of fairness system.
