作品出租权若干问题的思考——兼谈我国著作权法的完善

摘　　要：针对我国著作法中出租权主体不够全面、客体有所欠缺、权利的限制规定不明确等问题 ,提出我国著作权法中应增加表演者和广播电视组织 ,客体增加录有表演者表演的录音录像制品的原件、复制件和广播电视组织节目 ,规定善意租用的例外制度、合理使用制度。On analyzing some problems existing in rental rights of Chinese Copyright Law, the author suggests we should add performers and broadcasting television organizations as the subject of rental rights, add the originals and copies of a fixed performance and sound recording, picture recording and broadcasting television organization programmes as the object, lay down the rules concerning the exception system of rental in good faith, resonable use system and statutory licence system so as to set limitations to rental rights.
