摘 要: WTO争端解决机构经过近10年的运行,业已成为最重要的国际争端解决机构。然而,由于WTO立法行政机构较之其司法机构太弱,WTO规则本身模糊性强,加之其他原因,WTO专家组与上诉机构在具体争端解决中产生了以法官造法和对行政机构职能缺乏尊重为表现形式的司法积极主义。司法积极主义不仅与WTO的现有规定不一致,而且引发许多严重问题,并导致WTO危机加深。鉴于此,有必要改变WTO的现有体制,使其司法、立法与行政在机制上达到某种程度的平衡与制约。WTO dispute settlement mechanism,after nearly10 years'function,has become the most important Intemational Tribunal,nevertheless,judicial activism whose forms are law-making and lack of deference to executive bodies by Panel and Appellate Body has been caused due to relatively weak legislative and executive bodies of WTO ,ambiguity of WTO rules and some other things. Such kind of judicial activism is not only inconsistent with the provisisons of WTO agreements but also give rise to many serious problems which shoulb be avoided by the establishment of check and balance among the WTO's judicial,legislative and executive bodies.
