英美法系专家证人制度弊端评析

摘　　要：　我国的司法鉴定制度存在严重弊端,不少学者主张用英美法系的专家证人制度来取代现有的鉴定制度。文章通过研究英美法系国家司法改革的最新动态,发现专家证人制度本身也存在不可克服的弊端,认为我国在司法鉴定制度改革的过程中不可全盘照搬英美法系的专家证人制度,制度改革必须走制度融合的道路。There are many disadvantages in the system of judicial appraisal in China.Many scholars suggest that it should be substitud by the system of expert witness.The author opposes this suggestion,because there are also many disadvantages existing in system of expert witness through the study of the reform of judicial system in UKThe author suggests that we should not copy the system of expert witness
