两大法系贪污罪立法评析

摘　　要：外国刑法中虽然对贪污罪也是从严惩治,但英美法系或者大陆法系国家刑法对贪污罪的规定有所不同,即使是同一法系国家,其刑法对贪污罪的立法也未必一致。对外国刑法中的贪污罪做出比较分析,有利于更好地对我国贪污罪的立法加以反思,进而使我国刑法对贪污罪的立法合理化。Although corruption offence is severely punished, there are some differences between continental law system and common law system in criminal law, even in the same law system, different countries have some differences in the regulations. The comparative research is beneficial to retrospect the criminal legislation of corruption offence, which makes the legislation of corruption offence more proper.
