摘  要:经营者对第三人侵害消费者应承担何种责任涉及到经营者的安全保障义务问题 ,大陆法系和英美法系对经营者安全保障义务司法实践并不相同。经营者安全保障义务具有正当性和合理性 ,它本质上属于一种附随义务。经营者未尽合理谨慎的保障义务 ,将要承担补充赔偿责任。对于经营者安全保障义务 ,我国在理论研究上还比较薄弱 ,尽管立法、司法也涉及到了这个问题 。When consumers are hurt in the service place, what responsibility, or to what extent, the operator should take involves operator's responsibility for consumer's personal safety. The legal practice in Chinese mainland is different from that of Great Briton and the U.S.A, though both agree to the justice and rationality. The operator, who fails to fulfill the precaution duty, will undertake the responsibility of compensation. In China, though included in law system, the theoretic research is comparatively weak, so related law as well as regulations is supposed to be made to offer sound reference in court.
