摘　　要：司法解释体制的建立是司法解释规范化的重要标志,但不合理的司法解释体制会成为司法解释规范化的内生性障碍。在对司法解释界定的基础上,从制度、体制的层面上就现行司法解释的运作方式和过程进行反思,探讨了现行司法解释体制存在的弊端及原因,对我国司法解释的规范化与科学、理性的司法解释体制的建构等提出了改革与完善的建议。The establishment of the judicial interpretation system is an important symbol of the standardization of judicial interpretation; however,an irrational system will prove to be an internal obstacle to standardization. Based on the definition of judicial interpretation, the paper discusses the disadvantages of the current judicial interpretation system and their causes from the angle of the judicial interpretation operating mode and process, and puts forward some suggestions for the standardization of China's judicial interpretation,and the establishment of a scientific and reasonable judicial interpretation system.
