摘　　要：法治建设是当今社会呼声最高的内容之一 ,在眼下“法治热”的背景下 ,体育法治化也成为体育理论界关注的问题。作者从以下 3个方面论证了社会转型与体育法治建设的关系 ,即 :①体育法制的理想与体育法治的现实 ;②需要在理解中国体育实践的基础上推行体育法治 ;③在体育改革的同时 ,必须考虑到体育法治建设或制度生长所需要的社会稳定 ,这种辨证关系的把握是体育法治建设极为重要的。In the nowadays situation of 'legal rule hot', the construction of sports legal system has been popularly concerned about by the scholars of sports theory. The author discussed the relationship between social transformation and legal system constructions in sports in 3 aspects as following:①the paradox between ideal and reality of sports legal system; ②the necessity of the fulfillment of sports legal rule on the basis of sports practices in China; ③the same attention should be paid to sports reforms and social stability required by the construction of sports legal system and its development.
