论现代司法理念下的法官独立——兼谈我国法官制度的改革与完善

摘　　要：司法权作为一种判断权,独立性是其本质属性。司法独立包括司法职能的独立、司法组织的独立和法官的独立。其中法官独立是司法独立的核心和最高境界,是现代司法理念下审判独立的必然要求。本文拟从分析法官独立的价值内涵入手,着力剖析我国现行体制下的法官地位,并从法院体制、法官保障、法官管理等方面对如何保障我国的法官独立地位进行探讨。Judicature is one right of judgement, whose independence is its nature. Judicial independence consists of independence of judicature capacity, that of judicial organization and judges' independence, of which judges's independence is its core and supreme realm and is the inevitable demand of indelpendence of judge under the modern judicial idea. From analysing the value intension of judge's independent, the article probes into the judge status under our country current system. Furthermore, in order to gurantee the judges' independent, the author explores the court system, judge guarantee and judge management.
