摘　　要：欧洲法院作为欧共体的最高司法机关 ,在司法实践中大胆突破传统国际法的理论与实践 ,为欧共体司法制度的确立与发展作出了重大的贡献。欧洲法院通过其扩张性的司法解释 ,在确立了自身“宪法法院”地位的同时 ,解决了欧洲法院与成员国司法机关之间和欧共体法与成员国国内法之间的关系问题 。European Court of Justice (ECJ),the supreme judicial organ of the Community,has been made great contribution to the establishment and development of the Community judicial system through its radical legal practice,which greatly challenged to the traditional theory and practice of international law.While establishing its own 'constitutional court' position in the Community,the ECJ has solved some issues of the relationship between the Court of Justice and the national courts of the Member States as well as between the Community law in all the member sates.
