摘　　要：传统的刑罚正当根据学说主要有报应论、预防论、折衷论和忠诚论,但这四种学说不能构成刑罚正当根据学说的科学阐述。刑罚正当根据学说之科学立论是统一论。The traditional theories of criminal penalty warranty are mainly the theory of retribution; the prevention theory, the compromise theory and the loyalty theory. These four theories can not form a scientific expression of the criminal penalty warranty. The scientific theory should be the theory of unification theory.
