摘　　要：在现实生活中大量存在加害人只在一定的限额内承担赔偿责任的现象 ,本文称之为限制性损害赔偿。限制性损害赔偿制度具有一定的合理性。损害赔偿责任限额应当由合同或法律直接规定 ,一方因故意或重大过失造成对方损失 ,不得适用限制性赔偿制度。The phenomenon that the injurer only compensates limited damages commonly exists in reality, which is called as restrictive compensation. The system of restrictive compensation is somewhat reasonable. The limits of the compensation should be regulated by contracts or by statues. Anyone injures others in intentional misconduct or in material negligence can't refer to the limit of compensation.
