摘　　要：继承人旷缺是指继承人有无或生死不明的状态。为保障未知继承人、遗产债权人及其他利害关系人的利益,我国有必要建立完善的继承人旷缺制度,并对无人继承遗产的性质,遗产管理人的选任、职责、责任、权利,以及无人继承遗产的最终移交等问题予以明确规定。'Absence of Heirs' is the condition that whether there are heirs or the heirs are still alive is unknown. It is necessary for our nation to establish the system of absence of heirs, in order to protect the unknown heirs, creditors and other people's interests. In this system, the nature of legacy, the selection of supervisors and the supervisors' duty and right will all be clarified.
