摘　　要：《城市房屋拆迁估价指导意见》和《城市房屋 拆迁行政裁决工作规程》作为《城市房屋拆 迁管理条例》的补充,对于避免房屋评估的 随意性,规范行政裁决和强制拆迁行为,维 护被拆迁人合法权益具有重要意义。但是,由 于立法的出发点错位,不能正确定位政府在 城市房屋拆迁中职能,《城市房屋拆迁行政裁 决工作规程》对拆迁过程中各种行政行为规 范和调整仅仅是一种治标的手段,无法真正 从根本上解决城市拆迁问题。TheGuidingOpinionsfor theDis- mantlingEvaluation ofUrbanHouses andThe WorkingRulesof AdministrativeArbitrament for Urban Houses,as the supplement to The Managing Ordinance of Urban House Demolition,are ofimportancetoavoid thelib- ertyin house evaluation,to normalize thead- ministrativearbitramentandforceddemolition, andtomaintainthelegalinterestsoftheinvolved persons.Because ofthewronglegislativestart point,therolethegovernmentintheprocessof urban housedemolition cannot bemade sure, soTheWorkingRulesisonlyatemporarysolu- tiontonormalize thedifferentadministrative actions and regulations in the dismantling process,andcannotthoroughlysolvetheurban problemsoftheprocess.
