摘　　要：结合订立合同应当遵循的基本原则,论述了认定建筑工程承包合同是否成立应从以下几个要件着手,即:建筑工程承包合同主体是否合格;建筑工程承包合同内容是否符合法;建筑工程承包合同当事人的意思表示是否真实;建筑工程承包合同合同是否符合法定程序;建筑工程承包具体行为是否合法。According to the basic principles for entering into a contract, this article illustrates the essential elements for establishment for civil engineering contract for undertaking a project. The essential elements are as follows: eligibility of the subject for civil engineering contract for undertaking a project; legality of the contract contents for civil engineering contract for undertaking a project; authenticity of the declaration of will from the party for civil engineering contract for undertaking a project; legal proceedings for civil engineering contract for undertaking a project and legality of the specific acts for civil engineering contract for undertaking a project.
