摘　　要：1997年新刑法典的颁行 ,是我国刑法制度走向现代化的一个重要里程碑。新刑法典对正当防卫制度的修正 ,弥补了立法技术的缺撼 ,使司法实践更具操作性 ,从而在更大程度上鼓励了广大人民群众与犯罪行为作斗争的勇气。当然 。the implement of the new criminal code in 1997 was the milestone for the modernization of our country's criminal law system.the promotion of self-defence has also been drawn much attention.In recent years,a lot of suggestion on the self-defence has been issued in our theorization and practice of justification.Hereby the author will elucidate some opinions about it on the basis of others researches.
