关于单位累犯的几点思考

摘　　要：单位累犯是单位犯罪中的一项重要内容,建构单位累犯制度无论对于刑法理论还是对于司法实践都具有十分显著的意义。本文就现行刑法中是否规定了单位累犯、承认单位累犯的依据、单位累犯的刑罚条件及单位累犯的认定等四个问题进行了探讨。Unit recidivism is very important in the unit crime. The system of unit recidivism should be established, for it's really crucial to the theory of the penal law and the judicature. In this article, the writer discussed four topics: first, is there any provision of the unit recidivism in the penal law; second, the foundation of the unit recidivism; third, the punishment condition of the unit recidivism; fourth, how to cognize the unit recidivism.
