论特保条款中几个主要问题

摘　　要：]近来 ,一些 WTO成员纷纷针对我国采取特保措施 ,这已成为中国加入世界贸易组织后贸易磨擦增加的新问题。特保措施依据的“特保条款”是专门针对我国产品的歧视性条款 ,规定在《中华人民共和国加入议定书》第 1 6条和《入世工作组报告》的有关部分。本文结合 WTO《保障措施协定》关于一般保障措施的规定 ,就特保条款的实施条件、程序事项、报复机制等主要法律问题予以关注 。Recently other WTO members have frequently launched special safeguard enforcement to China, which has become one of the new factors causing the international trade fiction. Special safeguard clauses is a discriminatory rule special for China, which is made up of Section 16 of Protocol on the Accession of the People's Republic of China and no.245~250 of Report of the working party on the Accession of China. This essay focuses on its conditions of enforcement, procedure, retaliation and other law problems in order to deal with the practice.
