摘　　要：马克思主义相对自由意志的观点是职务过失犯罪负刑事责任的思想理论根据;职务身份、主观心理是职务过失犯罪负刑事责任的主观根据;违规行为和危害结果是职务过失犯罪负刑事责任的客观根据;而对刑事法规的违反则是职务过失犯罪负刑事责任的法律根据。职务过失犯罪刑事责任的根据呈多元性的特点。The article discusses the basis of penal responsibility of ministration defect sin on the basis of Maxism relative liberal will. Marxism relative liberal will is the basis of thinking theory of it ;ministration identity and subjective psychology are subjective basis of it ;action of getting out of line and harm result are impersonality basis of it ;infringing penal code is law basis of it.Thereby ,the basis of penal responsibility of ministration defect sin is varied .
