摘　　要：新的财产权客体的大量出现对大陆法系传统的财产权制度提出了严峻的挑战;物权、债权的严格界限也日益模糊。依靠传统的大陆法系的财产权制度和理念,这些问题不能得到很好的解决。因此,许多人把原因归结到物权与债权的严格划分上。而实际上,问题的症结所在是传统的、封闭的大陆法系的物权理论。<Abstrcat>The traditional property institution of Roman law system faces a serious challenge while lots of new object of property occur. The distinction between the property and the obligation has become fuzzy. But the traditional property institutions and ideas of Roman law system can't solve it very well. Therefore, many scholars consider the distinction between the property and the obligation as the reason. We think, in fact, the real one is the traditional, close property theory of the Roman law system.
