摘　　要：土地征用利益分配的严重失衡所带来的社会的不公正使对土地征用法律制度的改革刻不容缓。本文通过对我国现行土地征用法律制度中利益差序格局的分析 ,指出土地承包经营权和集体土地所有权对社会义务的过度负担和缺乏对国家土地征用权的有效制约是导致我国现行土地征用法律制度中利益差序格局的法律成因 ,进而提出改革土地征收征用法律制度、调整利益差序格局的建议。The off-balance on the distribution in the land expropriation system has brought out the severe injustice of the society and made the land expropriation reform of great urgency. Part one shows the arrangement of different status of the subjects interests in land expropriation. Part two attributes this to the excessive social duty on the collective ownership on the rural land and the land contract for the managerial right and the absence of effective check toward land expropriation owned by the state. Finally, part three provides some suggestions on the reform of land expropriation and land requisition legal system and the reconstruction of the arrangement of different status of the subjects interests.
