和谐社会的公法建构

摘　　要：和谐社会应当是一种和而不同的理性社会,能够全面回应多元价值诉求。现代和谐社会只能立于法治基础之上,并以公法为其脊梁,社会和谐与否直接取决于公法是否平衡。本文认为,现行公法处于失衡状态,这集中表现为社会关系因公共权力的越位、错位、缺位和不到位而无法得到全面理顺,社会因此出现一定程度的失调。中国要实现建构社会主义和谐社会的目标,核心是依法治国、建设社会主义法治国家,关键在于依法行政、建设法治政府;要遵循监督和规范公共权力与保护和拓展公民权利的公法制度变革主旨,采取国家主导和公众全方位参与相结合的方式,循序渐进地对公法加以结构性调整;要调整公共权力／公民权利结构,重塑制约与激励相容的公法机制,通过对症下药解决造成社会失调的公法失衡症结,全面推动和谐社会的建构。Harmonious society means a diversified and balanced society and it can only be achieved by rule of law,especially through the balance of public law. The paper points out that the key to achieve the goal of harmonious society is to establish a government ruled of law. It thinks that the gist of public law reform should check and regulate public power as well as protect and enlarge the citizens' rights, and the reform should be taken step by step with the involvement of state - oriented and public participation. It' s also necessary to adjust the structure between public power and citizen rights and re - establish the institution of public law to include restriction and inspiration.
