房屋典权法律性质辨析

摘　　要：文章认为 ,房屋典权是我国现有的、惟一的典权形式。它属于典型的用益物权 ,它具有用益性、占有性、独立性的法律性质。但由于我国立法等方面的原因 ,房屋典权的用益物权特性未能得到充分的体现 ,研究房屋典权 ,必须明确其涵义、剖析其法律性质 ,对于房屋典权制度的确立和完善、乃至于对我国的物权立法都具有重要的现实意义。This essay maintains that the housing usufruct is the only susfruct in china.lt is a typical usufruct which involves use right,occupancy right,and disposal right.Owing to some reasons with the law-making in china,the housing usufruct fails to fully express itself in the civil law.This essay explores the nature,significance and features of the housing usufruct in order to strengthen and improve our legislation in real right.
