摘　　要：大学生勤工俭学越来越普遍,而合法劳动权利受到侵害也越来越普遍。文章指出了勤工俭学的 本质特征,认为勤工俭学可形成劳动法意义上的劳动合同关系以及民法合同法意义上的雇佣合同关系,并提出 了相应的保护措施。It is more and more common for college students to work through study, so is the infringement of lawful right to work. The paper points out the nature of work through study, and regards that work through study can constitute the contract of labor in labor law and the contract of employmeat in civil law, and proposes corresponding protection measures.
