摘　　要：邮政合同是民事合同的一种。近年来邮政合同纠纷日渐增多,而司法实践中在适用《邮政法》还是《民法通则》的问题上存在严重的混乱。即将制定的《民法典》合同篇应对邮政合同作出统一规定,以有利于司法实践中纠纷的解决。Mail contract belongs to the civil contracts. As the disputes on mail contract increasing, the mess aggravates upon whether to apply the Law of the P.R.C. on Postal Service or to apply the General Principles of Civil Law of the P.R.C. on such disputes. After analysis of the concepts of the mail contract, the application of law on mail contract disputes, and the liability to compensate for the damage to the mail, the author claims that, to expedite the solution of disputes, a general provision of mail contract should be prescribed in the coming Civil Code.
