摘　　要：　在网络信息资源的开发利用过程中,如何解决网络传播中海量信息资源的著作权问题,已 经成为世界性的难题。但信息技术的不断发展,使用作品的方式和途径越来越多,著作权人对作品 的控制也越来越有限,而要求使用者逐一取得使用许可并支付费用基本上也不现实。因此网络环 境下我们有必要在坚持著作权保护基本原则的前提下,通过著作权的集体管理来加强对网络信息 资源的保护。建立和完善网络信息资源著作权集体管理制度应确定网络信息资源著作权集体管理 机构的组织形式,明确其法律性质和职责范围,并弄清网络信息资源著作权集体管理组织获得著作 权人授权的方式和将使用权授予使用者的方式。During the process of developing and utilizing network information resources,it has already become a global problem that how to deal with the copyright of the huge information spread in the network.With the evolving of information technology,there are more and more means of using works,less and less control which authors have on the copyright material,meanwhile it is unrealistic to require the users to gain the permit and pay for it one by one.So under the principle of protecting copyright,we should strengthen the protection by collective administration.To establish and perfect the collective administration system,we should fix on its organization form,make clear its legal characters and function area,and should find out how the collective administration institutes acquire the commission and how to grant the copyrights to users. [
