摘　　要：法律经济学分析 ,是法学与经济学相互渗透和交融的一种有效的研究方法。从市场风险、投资组合、交易成本理论和科斯定理角度分析 ,国际项目融资浮动担保法律制度具有降低交易成本、保障交易安全、加速资金融通和商品流通、提高债权救济效率等特殊功效 ,符合市场经济的内在要求。在法律上承认浮动担保方式 ,并予以充分的法律保护 。Economic analysis of law is an approach combined with the law and economic. The floating charge of the international project finance merits to reduce cost, to provide security of transaction, to accelerate the flow of capital and goods, to enhance efficiency of debt remedy from the perspective of the market risk, portfolio, transaction cost theory and Coase Theorem. It meets the internal needs of the market economy. It will improve our modern construction,we recognize the floating charge on legislation and give it efficient protection.
