摘　　要：新刑法典对诬告陷害罪作了重大完善 ,具有十分重要的意义。但在司法实践中 ,仍存在以下不足 :(一 )表述不规范 ;(二 )犯罪主体范围欠全面 ;(三 )对该罪的法律规定有遗漏。因而 ,应当进一步设置刑法典中的相关法条 ,以提高刑事立法质量 ,完备我国刑事法制。The new criminal code has greatly improved the content of the crime of false charge,which is significant.In the judicial practice,there still exist some drawbacks:(1)some statements are not standard;(2)the range of the main part of crimes is not so comprehensive;(3)there are some omissions in the legal stipulations of the crime.Therefore,some relative provisions are to be further installed in the criminal code to increase the quality of criminal legislation and perfect the criminal legal system of our country.
