摘　　要：本文主要围绕无效保证合同的认定及法律责任的承担问题 ,阐述保证合同无效的几种情形以及保证合同无效后 ,在不同情况下 。The paper chiefly concerns the determination of invalid contract of guaranty and the undertaker of legal responsibility.The first,to talk about circumstances of invalid contract of guaranty.The second,to talk about the nature of legal responsibility which parties bear;The third,to talk about how to share reponsibility for parties in invalid contract of guaranty.
