摘　　要：最大诚信原则是海上保险法的基本原则之一 ,合同双方当事人应遵循这一原则履行合同 ,互负最大诚信义务。但被保险人的最大诚信义务往往占据了这一原则在立法与司法实践中的主导地位 ,各国学术讨论与理论研究也多未涉及该原则对保险人的具体要求。鉴于此 ,本文拟从我国相关法律规定与司法实践出发 ,借鉴英美法有关法例 。A contract of marine insurance is a contract based upon the Utmost Good Faith, which should be observed by either party. However, laws and precedents with respect to the Utmost Good Faith duty of marine insurer have still seldom been focused on by academic study all over the world. In order to make an effort to map the theoretical and practical framework of the duty in a preliminary way, this article analyzes laws and cases in P.R.C in this respect, and then makes a study of the relevant precedents and statutes in Anglo American law for reference.
