摘　　要：文中结合实体法和程序法有关海上保险代位求偿权的具体规定 ,力求将二者融会贯通 ,指出实践中出现或可能出现的问题 ,明确立法存在的缺陷并提出修改意见 。In conjunction with the particular provisions of the substance and procedure law involving the right of subrogation in marine insurance for the purpose of keeping harmonization between the provisions of the substance law and the procedure law, the paper indicates the current and forthcoming questions in practice and the defects of legislation, and then expresses some opinions of making perfect of the system of right of subrogation of our country.
