摘　　要：本文从买卖合同与运输合同的法律关系来探讨海上货物运输控制权的必要性和合理性。结合相关立法 ,对 CMI运输法草案就控制权条款进行评析 ,并介绍我国关于控制权的现行法律及立法动态。This paper will discuss, based on the relation between the contract of sale of goods and the contract of carriage of goods by sea, whether the right of control is necessary and reasonable. It will comment on the clauses of right of control in the Transport Law, linking the relative laws of the countries of the world, and put forward the revised advice. It will introduce the present law and legislating development of our country.
