摘　　要：信用证为独立自主的契约 ,但是在肯定这一原则的前提下如有欺诈发生则允许银行不予付款或承兑 ,法院也可发布禁止支付令。但是 ,欺诈例外原则只是一种法律救济手段 ,不得滥用。Letter of credit is a kind of independent and autonomous contract. However, the bank may refuse to pay or accept a letter of credit and the court may issue order to prohibit the payment of it if fraud is found in the transaction. The exception of fraud is only a kind of legal remedy, which may not be abused.
