摘　　要：论述了国务院《医疗事故处理办法》所界定的有关法律责任关系中的法理原则等问题:明确医疗纠纷的法律关系,以综合防制措施依法管理,运用协商为主的处理方法,坚持技术鉴定的法定制度,严格遵循尸检的法定原则,做好行政调解和行政处理。The author discussed problems on legislative principles with regarding to the relevant lawful responsibility relationship defined in Resolving Methods of Medical Malpractice which was issued by the State Council. These problems include: To clarify the lawful relationship in medical dissension, to manage based on law in comprehensive measures, to resolve it by negotiation, to insist the lawful regulation of technical checking, to obey lawful regulation of autopsy and to manage the resolve.
