摘 要:建筑物区分所有权是多层建筑物发展的产物 ,其内容经历了一个从一元论到二元论再到三元论的演变过程。建筑物区分所有权中的成员权是建筑物区分所有权的组成部分 ,与建筑物区分所有权中的专有权、持分权相比 ,有自己的内容与特点。《中国物权法草案建议稿》中参照外国的立法例对成员权作了较周密的设置 ,但仍有许多值得商榷之处。The condominium refers to a product of the development of multi-storied buildings whose contents have evolved from monism, dualism to pluralism (three). Compared with the exclusive right and the share holding right in the condominium, the membership right, another part in it, has its own contents and characteristics. Though the thorough layout has been made on the membership right by referring to some foreign legislation cases in China's Real Right Draft (suggested), there are still many points to be discussed about it.
