宪政制度中的幽暗意识辨析

摘　　要：幽暗意识是宪政制度的价值基石。它不同于作为德性政治基础的忧患意识,也不同于作为专制政治基础的阴暗意识。通过对幽暗意识与忧患意识、阴暗意识的辨析,我们看到正是幽暗意识发展出了以制度理性为特征的宪政制度,幽暗意识成就了理性政治的价值基础。对转型中国的宪政追求而言,通过培育幽暗意识,来发展以制度理性为重点的理性政治是其惟一选择。Dim consciousness is a value foundation stone of the constitutional institution.It is different from the suffering consciousness of the political foundation of moral character and the dark consciousness regarded as the (autocratic) political foundation.Through differentiating and analysis of the dim consciousness,suffering consciousness, and dark consciousness,we can see that it is the dim consciousness that develops the constitutional institution as characteristic,value foundation of dim consciousness achievement of rational politics.To the transition of China’s constitution,through cultivating dim consciousness,it is China’s only choice to develop rational politics.
