试述提单持有人的概念、识别及我国的立法建议

摘　　要：鉴于我国《海商法》立法中对提单持有人定义的缺乏及对提单持有人法律地位规定的不明确。本文针对我国《海商法》的现行规定,从提单持有人的概念,识别及今后立法建议三方面对提单持有人问题加以论述,指出了我国《海商法》法条中所使用的提单持有人的含义,提出应以是否经正当转让程序作为识别提单持有人身份的依据,并在定义和权利、义务的规制方面提出立法建议。As the lack of the definition and the l egal position of b /l holders in Chinese maritime code,this paper discuss the issue from the poin ts of b /l holder' s definition,identification and le gislation advices.This paper also points out the meaning of b/l holder in Chinese maritime law,gives the view that it should be deemed as the standard in the identif ication of b /l holders,whether the b /l' s negotiation through appro-priate procedure and moreover gives legal advices in b /l holders' definition and its rights and obliga tions.
