摘　　要：背景音乐收费制度尊重和保护了著作权人的利益。我国的现行法律及加入的国际条约已为其实施奠定了基础。健全的集体管理机构和合理的费用分配是其良好运作的前提。背景音乐收费制度是社会进步的标志,体现了“公”利益和“私”利益的平衡,其实施也是我国履行相关国际承诺的必然。目前其实施过程中面临的一些问题,促使我们应加大知识产权保护宣传力度,完善有关立法,健全集体管理机构,提高其实施透明度。To pay for background music is an ideal legal mechanism on behalf of creators of musical works. The mechanism must be based on our laws and international treaties that had been enforced in our country. Flawless collective management and reasonable distribution of background music fees make the mechanism run right. The mechanism is a mark of social progress and balance interests between the public and the private. Implementing it is our duty for our international promises. Nowadays, there are some questions in practice, so we should enhance our propagation about Intellectual Property Protections; amend our legislations, strengthen collective management, and heighten transparency in the process of implementing laws.
