摘 要:当前关于公共利益的研究,在公共利益立法诉求与理论特性、公共利益与行政权、公共利益与法律、公共利益与公众心理以及公共利益研究目的与研究结果的关系中都存在着悖论,而这些悖论告诉我们必须对公共利益标准的制定转换视角。我们应该放弃对公共利益标准的制定,回归到约束行政权力尤其是保护公民个人权利的行政法治轨道上来,而最终我们会发现,以个人利益为出发点和皈依的公共利益其实只是行政权力与公民权利博弈实现行政法治后必然的剩余价值。而在这一实践过程中,"政府法治论"应当是最合适的指导思想。In the research of public interests at present, there are paradoxes concerning the relations between legislation resort and the theoretical characteristics in public interests, public interests and administrative power , public interests and law, public interests and public psychology and the purpose of public interests research and its result. And these paradoxes tell us to change the perspectives of forming the public interests standard. We should give up formulation of standard for public interests, and come back to the track of restraining administrative power, especially to protect the individual rights of citizens. We will find finally that public interests which take individual interest as its starting point and end is the surplus value after the competition between administrative right and the citizens' right. While this one is practiced, 'government's theory governed by law' should be the most suitable guidelines.
