摘 要:城市房屋拆迁行为本质上应属于民事法律行为。但是,现行法律对拆迁行为性质认识的错位,行政权力的不当介入和拆迁补偿的不到位是当前城市房屋拆迁中公民私权屡受侵犯的根源所在。所以,应对现行拆迁制度进行调整,将拆迁当事人已达成拆迁补偿安置协议作为拆迁许可的法定条件,废除行政裁决制度和强制拆迁制度。同时,真正实现拆迁房屋的市场化定价,并将对拆迁房屋的补偿范围扩大到包括对相关国有土地使用权的损失,实现对被拆迁人公平合理的补偿。The lawful nature of urban housing removal should be civil juristic act essentially. In the current legal system the nature of the urban housing removal is dislocated; the administrative power's interfering is not appropriate; the compensation for urban housing removal is not sufficient. All of the above reasons lead to the intrusion of citizens' rights. So we should adjust the current legal system by modifying the follow aspects: first of all, one urban housing removal will not be licensed before the removing parties reach the agreement of compensation and settlement, and the system of administrative adjudication and the imperative executive system of urban housing removal should be abolished. Secondly, the price of the house referred in the removal should be established by market, and the compensation should be extend to the loss of the correlative state-owned right of land use in order to reach a reasonable and impartial compensation to the party whose house was removed.
