摘　　要：侦查阶段在整个刑事诉讼过程中尤为重要,而存在的问题也最为突出,根本原因是缺乏一个中立的、事中的监督者。刑事诉讼法规定,人民检察院是监督机关,但是由于人民检察院内部机构与职能分工上往往集双重身份为一身,导致了监督的无力。为此,应当从调整检察机关内部机构和职能分工上改变警检关系入手,建立一系列确保人民检察院监督超然性的制度,确保监督的现实性和有效性,以实现监督的公正性。The stage of investigation is vital for the who le process of criminal lawsuit.However ,in this stage ,there exist outstanding problems which caused mostly by a fact that we are short of a neutral supervisor.The criminal law suggests that the people's proc uratoration is an organ for supervision ,while it's bilingual identity caused it's inefficiency.Therefore ,we should begin with the changing of the relationship between the organs o f public security and procuratoration ,setting up a sequence of rules for ensuring the detachment reality and eff ectiveness of supervision to realize the justice of it.
